6 mai 2026 \u00e0 Ouagadougou, le projet de loi portant Code du travail au Burkina Faso.<\/strong><\/p>\n<p><a le Pr\u00e9sident de l\u2019ALP, Dr Ousmane BOUGOUMA, s\u2019est tenue en pr\u00e9sence du Ministre des Serviteurs du Peuple, Mathias TRAORE, accompagn\u00e9 de ses collaborateurs.<\/p>\n<p>Adopt\u00e9e \u00e0 l\u2019unanimit\u00e9 par les 59 d\u00e9put\u00e9s votants, cette loi s\u2019inscrit dans la vision du gouvernement de doter le pays d\u2019un instrument juridique moderne, apte \u00e0 favoriser la cr\u00e9ation d\u2019emplois, \u00e0 valoriser le capital humain, \u00e0 renforcer la productivit\u00e9 des entreprises et \u00e0 accro\u00eetre leur comp\u00e9titivit\u00e9 au service de la souverainet\u00e9 nationale.<\/p>\n<p><a g\u00e9n\u00e9rales, institutionnelles et des droits humains (CAGIDH). Par la suite, la Commission des finances et du budget (COMFIB) ainsi que la Commission du genre, de la sant\u00e9, de l\u2019action sociale et humanitaire (CGSASH) ont chacune livr\u00e9 leurs rapports, ouvrant la voie au d\u00e9bat g\u00e9n\u00e9ral.<\/p>\n<p>Ce d\u00e9bat a permis aux d\u00e9put\u00e9s d\u2019interroger la CAGIDH et le gouvernement sur divers aspects du nouveau code.<\/p>\n<p><a href=\"https:\/\/www.sidwaya.info\/code-du-travail-au-burkina-faso-le-projet-de-loi-adopte-par-les-deputes-de-lassemblee-legislative-du-peuple\/fb_img_1778097658921\/\" apport\u00e9 des r\u00e9ponses aux pr\u00e9occupations soulev\u00e9es, pr\u00e9cisant que le nouveau Code du travail, structur\u00e9 en 10 titres, 30 chapitres et comportant 441 articles, introduit plusieurs innovations majeures.<\/p>\n<p><a notamment sur :<\/p>\n<p>-la limitation du nombre de renouvellements du contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD). En effet, le CDD ne peut pas \u00eatre renouvel\u00e9 plus de deux fois avec le m\u00eame travailleur. Il ne peut \u00eatre conclu un CDD plus de trois fois avec le m\u00eame travailleur dans la m\u00eame entreprise de fa\u00e7on continue ou discontinue ;<\/p>\n<p>-l\u2019encadrement de l\u2019exercice des activit\u00e9s de travail temporaire \u00e0 travers, entre autres, la limitation de la dur\u00e9e de mise \u00e0 disposition d\u2019un travailleur \u00e0 un an, la fixation du principe d\u2019\u00e9galit\u00e9 de r\u00e9mun\u00e9ration entre le travailleur temporaire ou int\u00e9rimaire et celui de l\u2019entreprise utilisatrice ayant la m\u00eame qualification professionnelle et occupant le m\u00eame emploi et la limitation des cas dans lesquels une entreprise utilisatrice peut recourir au travail temporaire ;<\/p>\n<p>-l\u2019institution et l\u2019encadrement du t\u00e9l\u00e9travail eu \u00e9gard aux nouvelles formes d\u2019organisation du travail et tenir compte de l\u2019\u00e9volution des nouvelles technologies et de la Covid 19 ;<\/p>\n<p>-le rel\u00e8vement du montant des dommages et int\u00e9r\u00eats de 18 mois \u00e0 24 mois de salaire pour les travailleurs afin de limiter les abus en mati\u00e8re de licenciement ;<\/p>\n<p>-le rel\u00e8vement du seuil pour faire appel en cas de jugement de 200 000 FCFA \u00e0 1 000 000 FCFA pour limiter les abus en mati\u00e8re d\u2019appel ;<\/p>\n<p>-l\u2019am\u00e9lioration de la proc\u00e9dure de la gestion des conflits collectifs de travail \u00e0 travers la fixation d\u2019un d\u00e9lai de trois mois au conseil d\u2019arbitrage pour rendre la sentence arbitrale afin d\u2019acc\u00e9l\u00e9rer la proc\u00e9dure et lever les restrictions du droit de gr\u00e8ve et l\u2019instauration du pourvoi en cassation en cas du refus d\u2019une des parties ;<\/p>\n<p>-l\u2019encadrement de l\u2019embauche des travailleurs non nationaux \u00e0 travers l\u2019autorisation pr\u00e9alable du service public d\u2019emploi pour tout employeur qui veut recruter un travailleur non national non-r\u00e9sident, l\u2019obligation de disposer d\u2019un permis de travail et l\u2019obligation de viser le contrat de travail du non national non r\u00e9sident avant tout d\u00e9but d\u2019ex\u00e9cution du contrat de travail ;<\/p>\n<p>-la prise en compte du harc\u00e8lement moral et la red\u00e9finition du harc\u00e8lement sexuel en milieu de travail pour permettre la poursuite judiciaire des personnes coupables de tels actes ;<\/p>\n<p>-l\u2019harmonisation de la dur\u00e9e du contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e \u00e0 deux ans pour les nationaux et les non nationaux pour lever la discrimination qui d\u00e9favorisait les travailleurs nationaux ;<\/p>\n<p>-l\u2019obligation de renouveler le visa du contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e du travailleur non national non r\u00e9sident tous les deux ans afin de mieux surveiller le recours \u00e0 l\u2019expertise \u00e9trang\u00e8re ;<\/p>\n<p>-la reconnaissance de la force majeure comme une cause de mise en ch\u00f4mage technique et non une cause de suspension syst\u00e9matique sans solde du contrat de travail ;<\/p>\n<p>-l\u2019augmentation de la dur\u00e9e de la p\u00e9riode de suspension de six \u00e0 dix mois du contrat du travailleur d\u00e9tenu qui n\u2019a pas commis de faute professionnelle pour mieux prot\u00e9ger les travailleurs dans cette situation ;<\/p>\n<p>-l\u2019augmentation de la dur\u00e9e du repos pour allaitement de 14 mois \u00e0 15 mois au profit de la femme salari\u00e9e pour une harmonisation avec la dur\u00e9e du repos pour allaitement de la femme fonctionnaire ;<\/p>\n<p>-l\u2019augmentation de la dur\u00e9e maximum des permissions exceptionnelles de dix (10) \u00e0 quinze (15) jours pour des \u00e9v\u00e9nements \u00e0 caract\u00e8re social touchant le travailleur ;<\/p>\n<p>-l\u2019institution du pr\u00e9l\u00e8vement volontaire \u00e0 la source des cotisations syndicales appel\u00e9es check-off ou pr\u00e9compte syndical pour faciliter le recouvrement des cotisations des syndicats ;<\/p>\n<p>-la mise en place du Comit\u00e9 de s\u00e9curit\u00e9 et sant\u00e9 au travail \u00e0 partir de vingt-cinq (25) travailleurs au lieu de trente (30) pour am\u00e9liorer la s\u00e9curit\u00e9 et la sant\u00e9 au travail d\u2019un plus grand nombre de travailleurs.<\/p>\n<p><a
